A few states, like Washington, Nevada, and Connecticut among them, give you extra rights over health information collected before you ever become a patient. This notice is a standalone explanation of that specific data: what we collect, where it comes from, who we share it with, and how to make us delete it. It’s short on purpose.

This Consumer Health Data Privacy Notice (“Health Data Notice”) explains how Bloom360, Inc. (“Bloom360” or “Company”) and its affiliated professional medical entities, including Bloom360 Medical PLLC (“Practice,” and together with Bloom360, “we,” “us,” or “our”), handle consumer health data, including on our website available at bloom360.com and our other online or offline offerings which link to, or are otherwise subject to, this notice (collectively, the “Services”).

This Health Data Notice applies to consumer health data that is not regulated by the Health Insurance Portability and Accountability Act (“HIPAA”). Information we collect from or about you after you have logged in and become a patient is generally protected health information governed by HIPAA and our Notice of Privacy Practices, not this Health Data Notice. In plain terms: this notice covers the health information you share with us while you’re still deciding. Once you’re a patient, the stronger HIPAA rules take over.

Consumer health data is personal information that is linked or reasonably linkable to you and that identifies your past, present, or future physical or mental health status. Because this term is defined broadly under applicable state laws, it may include information you provide before becoming a patient or information collected through your general interactions with our website and marketing materials. We’d rather over-explain this than have you guess.

Examples of consumer health data we may collect include:

  • Health status information, such as health conditions, symptoms, diagnoses, or treatments you share when exploring our Services before logging in
  • Medical history, including information about medications, surgeries, or procedures
  • Reproductive or sexual health information
  • Information about healthcare services you are seeking, such as when you complete a quiz, take a health assessment, or visit a landing page about a specific condition
  • Bodily measurements, such as height, weight, or vital signs you share outside of a clinical encounter
  • Inferences about your health derived from other data, including the fact that you may be visiting our Services to seek healthcare

We collect consumer health data in the following ways:

  • Information you provide to us: Consumer health data you share when you use our Services, complete forms or assessments, or otherwise interact with us before logging in to your account.
  • Information collected automatically: We automatically collect certain information when you visit or navigate our website, including through cookies and similar technologies. This may include browsing activity on health-related pages.
  • Information from third parties: We may receive consumer health data from third parties, such as healthcare providers or partners, where permitted by law.

We use the consumer health data we collect for the following purposes:

  • To respond to your inquiries and provide information about our Services
  • To analyze, personalize, and improve our Services
  • To comply with our legal obligations
  • To create de-identified or aggregated data that can no longer identify you, in compliance with applicable law
  • To detect and prevent fraud, protect our rights, and ensure the security of our Services
  • To operate our business, including for corporate transactions and legal proceedings
  • For other purposes for which we obtain your consent as required by law

We may share consumer health data with the following categories of recipients, and only when there’s a reason we can explain to you:

  • Service providers that perform services on our behalf, such as data hosting, analytics, cybersecurity, and technology support. Our service providers are contractually prohibited from using your consumer health data for any purpose other than to provide services to us.
  • Professional advisors, such as lawyers, auditors, and consultants, where necessary in the course of their professional services.
  • Government or law enforcement officials, as required by law or as we believe necessary to comply with applicable law and legal process.
  • In connection with a business transaction, such as a merger, acquisition, sale of assets, or reorganization.
  • With your consent, where required by applicable law.

We also share consumer health data between our own affiliated entities, like Bloom360, Inc. and Bloom360 Medical PLLC, as needed to respond to you, deliver your care, and run our operations.

We do not sell consumer health data. We don’t have a version of this business where we would.

Certain third parties with which we partner may use cookies and similar tracking technologies to collect information about you from our Services. This information may include consumer health data. Depending on where you live, you may have the following rights regarding your consumer health data:

  • Right to Confirm and Access: You have the right to confirm whether we are collecting, sharing, or selling your consumer health data and to access that data.
  • Right to Delete: You have the right to request that we delete your consumer health data.
  • Right to Withdraw Consent: If you provided consent for our processing of your consumer health data, you have the right to withdraw that consent.
  • Right to Correct: You have the right to request that we correct inaccurate consumer health data.
  • Right to a List of Third Parties: You have the right to receive a list of third parties with whom we have shared your consumer health data.

We will not treat you unfairly for exercising your rights.

We will respond to your request within 45 days. We may ask you to verify your identity before processing your request.

Washington residents may file complaints with the Washington State Attorney General at www.atg.wa.gov/file-complaint.

If we deny your request, you may appeal by emailing privacy@bloom360.com with the subject line “Privacy Rights Appeal.” We will respond to your appeal within the timeframe required by applicable law, and we will tell you how to contact your state attorney general if you disagree with the outcome.

We may update this Health Data Notice from time to time. When we do, we will post the updated notice on this page and update the "Last Updated" date. We encourage you to review this page periodically.
